CONFIDENTIALITY UNDERTAKING

(employee, consultant or trainee)

WHEREAS, I have / my employer or company has entered into a contract of employment, a

services agreement or a trainee/stagiaire agreement with the Centre intégré de santé et de services

sociaux du Centre-ouest-de-l’Île-de-Montréal (hereinafter the “CIUSSS”);

WHEREAS, in connection with my employment with the CIUSSS, in connection with the

performance of my services agreement for the CIUSSS, or in connection with the trainee/stagiaire

agreement that I have entered into with the CIUSSS, I may have access to certain information

and/or documents that are of a confidential nature and which relate, in particular, to the CIUSSS’

users and/or employees;

WHEREAS, the CIUSSS must respect certain obligations relating to the confidentiality of

information concerning its users, including, in particular, information which is contained in their

health and social services records;

WHEREAS, the CIUSSS must respect certain obligations relating to the confidentiality of

information concerning its employees;

THEREFORE:

1. I acknowledge that all information or documents relating to the users of the CIUSSS,

including, in particular, the content of the health and social services records concerning such

users, and all information or documents relating to the employees of the CIUSSS, including,

in particular, the contents of employees’ records, are considered confidential information

(“Confidential Information”);

2. I understand that any disclosure of Confidential Information, whether directly or indirectly, to

any third party could be highly damaging to the CIUSSS, its employees or its users.

Therefore, I agree that I will not share and will not use such Confidential Information, in any

manner whatsoever, whether in whole or in part, for any purposes other than those which are

related to my employment with the CIUSSS, to the performance of my services agreement

with the CIUSSS or to the trainee/stagiaire agreement that I have entered into with the

CIUSSS;

3. I undertake not to transmit any Confidential Information nor to transport any document

containing such Confidential Information outside the premises of the CIUSSS, unless

necessary for my employment with the CIUSSS, for the performance of my services

agreement with the CIUSSS or for the trainee/stagiaire agreement that I have entered into

with the CIUSSS;

4. I undertake not to reproduce any Confidential Information except as required as part of my

employment with the CIUSSS, as part of the performance of my services agreement with the

CIUSSS or as part of the trainee/stagiaire agreement that I have entered into with the

CIUSSS;

5. I undertake to return any and all copies of any such Confidential Information to the CIUSSS

upon the termination of my employment with the CIUSSS, upon the termination of my

services agreement with the CIUSSS or upon the termination of my trainee/stagiaire

agreement with the CIUSSS, and undertake not to keep any copies of any such Confidential

Information in any format whatsoever;

6. Given the nature of Confidential Information, I hereby undertake to abide by the obligations

created under the present Confidentiality Undertaking at all times after the termination of my

employment with the CIUSSS, the termination of the services agreement with the CIUSSS or

the termination of the trainee/stagiaire agreement that I have entered into with the CIUSSS;

7. I undertake to take all necessary security measures to protect any Confidential Information

which I will have access to in connection with my employment with the CIUSSS, with the

services agreement with the CIUSSS or with the trainee/stagiaire agreement that I have

entered into with the CIUSSS;

8. I undertake to immediately inform the President and Executive Director of the CIUSSS of

any breach of the obligations provided for under this Agreement or of any event that could

potentially undermine the security or confidentiality of the Confidential Information;

9. I undertake to allow representatives of the CIUSSS to perform any verification or

investigation relating to the confidentiality of the Confidential Information.
